The Valencia High Court of Justice has sentenced a local council to compensate a man with 3,000 euros for its passivity in a conflict between neighbours, due to the barking of a dog that prevented him from sleeping, working and living a normal life.
The affected neighbour asked for 60,000 euros, but the Court has rejected that the dog's noises are the cause of his anxiety. The neighbour had endured the situation since 2010.
The Court, however, rejects the confiscation of the animal because the infringement of the individual's fundamental rights to personal and family privacy and to inviolability of the home is a situation that has already occurred and has been exhausted, and these rights cannot be restored through confiscation, but through the award of compensatory damages.
