The Spanish company knew about the fertility treatments of the employee and his wife, but when the company found out that the employee was going to become a father it dismissed him.
The Spanish court did not find in favour of the employee, considering that there was no discrimination.
However, on appeal, the High Court of Justice of Cantabria, Spain, considers it a discriminatory act, since, even if the company knew about the fertility treatments, it is not the same as knowing that its employee was sure to become a father.
