The Court of Justice of the European Union (CJEU) has admitted a new preliminary ruling on the IRPH mortgage index raised by Carmen Robles Zamora, the head magistrate of the second examining magistrate's court in Ibiza.
The magistrate has referred a total of 16 questions to the European Court for a preliminary ruling on the interpretation of articles 3, 4, 5, 6 and 7 of Council Directive 93/12 EEC of 5 April on unfair terms in consumer contracts, suspending the proceedings until the resolution of these questions referred to the CJEU.
These questions for preliminary rulings are in addition to the six submitted last December by the head of the 38th Court of Barcelona, Francisco González de Audicana, who considered that they had remained unclear. Read more
