Civil servants who suffer such accidents are entitled to the extraordinary pension for permanent disability, plus money, in the same way as if the accident takes place in the office.
Accidents on the way to work are acts of service, says the High Court. The Chamber has handed down two rulings in which it recognised the right to receive such a pension, the basis of calculation of which is 200 per cent, for a prison officer and a woman civil guard, considering that the accidents they suffered on the journey between home and the workplace were the result of work.
In the case of the prison officer, the accident occurred when he was travelling from his home to the Daroca Penitentiary Centre (Zaragoza) to take charge of the service assigned to him on the afternoon shift on 14 October 2010. The Directorate General for Personnel Costs and Public Pensions rejected that the accident occurred while working. This decision was confirmed by the Central Economic Administrative Court.
The female civil guard suffered a traffic accident on 11 June 2014 while on her way from her usual place of residence to her duty station at the Civil Guard Headquarters in Tarragona. The Ministry of Defence declared him permanently incapacitated, due to insufficient psychophysical conditions, unrelated to an act of service.
