Parents denounced for abuse will not be able to visit their children as of 3 September, with the entry into force of the reform of the Civil Code which places limits on such contact.
The new article 94 of the Spanish Civil Code establishes that "the establishment of a visiting regime will not proceed, and if it does exist, it will be suspended, with respect to the parent who is involved in criminal proceedings initiated for threatening the life, physical integrity, freedom, sexual freedom of the other spouse or their children".
"Nor shall it be applicable when the judicial authority notices, from the allegations of the parties and the evidence, the existence of well-founded indications of domestic or gender-based violence. However, the judicial authority may establish a visiting regime in the best interests of the minor...". continues the new article.
Finally, it states that "in no case shall it be appropriate to establish a visiting regime with respect to the parent who is in prison, either provisionally or by final judgement, agreed in criminal proceedings for the offences set out in the previous paragraph".Read more.
