The Provincial Court of Álava, in Spain, has declared null and void as abusive the two-euro fee that Bankinter had been charging non-customers for cash deposits over the counter.

In the opinion of the Provincial Court of Alava, the charging of this fee does not comply with the requirements of Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts, and constitutes an "obvious obstacle" for the consumer who intends to make a deposit.

In September 2021, Commercial Court No. 1 of Vitoria-Gasteiz already fully upheld the lawsuit filed by the representation of the Basque Association of Consumers and Users.  Read more.
