Articles 7, 9, 10 and 11 of the royal decree of 14 March declaring the state of alarm, the royal decrees approving its successive extensions and the order of the Ministry of Health establishing exceptional measures in relation to funeral wakes and ceremonies to limit the spread and spread of COVID-19 will be reviewed.

With its appeal, "Vox" wants to determine whether the Government's actions constitute "a flagrant violation" of the Constitution by "abusively and unjustifiably" using the state of alarm and violating citizens' fundamental rights. Its spokesman, Jorge Buxadé, argued that the state of alarm only allows for limiting the free movement of people and stressed that if the Government intended to suspend fundamental rights, "as it has done", it should have opted for the state of emergency and asked Congress for authorization from the outset.

Among the rights allegedly violated are the rights of assembly, demonstration and education, according to Vox, for whom "the Government has done through the state of alarm what it should have done through the state of emergency". Read more
