The High Court of Justice of the Basque Country (TSJPV) has ruled that the Basque Health Service-Osakidetza failed to comply with the regulations on the prevention of occupational risks during the coronavirus health crisis and that the lack of personal protective equipment (PPE) represented "a serious and imminent occupational risk" to the health of its workers.
In a note from the ESK trade union, he demanded that both the Osakidetza management and the Regional Minister of Health, Nekane Murga, "assume their responsibilities and present their resignation due to the disastrous management of these tense months, which has endangered the health of both the Osakidetza staff and the citizens they assist".
According to the union, the TSJPV states in its ruling that "in relation to the masks and gowns, Osakidetza gave instructions for use, reuse and washing that had nothing to do with health indications and that they left out the recommendations for use that warned of the potential risk of infection for the patient and for the user that their reuse entailed".
