In the opinion of the Advocate General of the European Court of Justice (ECJ), the fact that a flight lands at an airport other than that for which the reservation was made, located in the same city or in the same region, does not give rise to a right to compensation for cancellation of the flight.
This refers to the case of a passenger of Austrian Airlines who claims compensation because his flight to Berlin was diverted to Schonefeld airport, when it was scheduled to land at the other airport of the city, in Tegel. The customer claimed damages because he had to make a longer journey to his place of accommodation without the company offering an alternative transport.
According to the European legislator, the right to compensation arises only if, as a result of such a detour, the passenger arrives at the airport for which he made the reservation or at another agreed nearby destination with a delay of three hours or more. Read more
