The first six weeks must be enjoyed simultaneously and compulsorily after delivery and the other 10 weeks can be added or taken in minimum weekly periods.
As of this Friday, January 1st, paternity and maternity leaves are equal to 16 weeks, a measure that seeks to advance in the co-responsibility and in the reduction of labor gaps, and for which 2,784 million Euros have been allocated this year.
This milestone, contemplated in a decree law approved in March 2019, makes both parents equal and establishes that the benefit for birth, adoption, foster care and adoption purposes is an individual and non-transferable right.
The benefit covers 16 weeks, 6 of which must be enjoyed simultaneously and compulsorily immediately after the birth or judicial or administrative decision in the case of adoption, guardianship or fostering.
The other 10 weeks can be added to the 6 compulsory weeks or taken in an interrupted manner in minimum weekly periods during the baby's first year. The enjoyment of this period full or part time will require an agreement between the company and the worker.
According to Social Security data, this extension is expected to benefit 236,000 parents in 2021, and 2,784 million have been allocated for this purpose, 11.4% more than in 2020. Read more
