The Provincial Court of Cantabria has sentenced to nine months in prison a salesman who swindled a 78-year-old man, "in a situation of lesser capacity of understanding" due to suffering from an illness, with the financed sale of a mattress.
According to the sentence, the accused, "with the preconceived idea of obtaining an illicit economic benefit", formalised a personal loan contract for the purchase of a mattress for 1,896 euros, which he sold at the home of the elderly man.
The victim had already bought a new mattress four months before, also with financing and, despite knowing this circumstance, the seller told him that it was from the same company that had sold it to him before and that they kept the old one, as it was under guarantee, and that he could buy the new one paying only 400 euros more.
Thus, "he made her sign a new loan, which did not eliminate the old one and, of course, he did not withdraw the first mattress, as it was not true that one payment was replaced by another, as it was really a second financing added to the first one". Read more.
