Child support in the event of divorce in Spain must be paid by both parents, regardless of whether the financial situation of one parent is very high and superior to that of the other.
This has been determined by the Provincial Court of Granada in a ruling in which the costs of the children's education are divided between the parents, in proportion to their income.
In the parents' divorce proceedings, the father appealed the divorce decree which, establishing shared custody of the two children, obliged him to pay only for the children's private school.
The mother wanted the father to pay the full cost of the children's private school, because the father's income was higher.
However, the Granada Court ruled that the fact that one parent has a higher income than the other, even if it is very high, does not exempt the other parent from fulfilling his or her obligation to contribute to the maintenance of the children, as both are obliged to do so. Read more.
