The Provincial Court of Cantabria sentenced a bank to pay a co-owner of a bank account (who sued) the money in that bank account, although the other co-owner had also claimed the money out of court.
A co-owner of the current account claimed payment of the full amount of the money from the bank. This request was denied by the bank, alleging "that she did not provide a document proving that the other co-owner agreed". Therefore, the bank decided that it should not hand over the money.
As the judgment explains, the bank can pay any of the co-owners, and can choose which of them it pays; but it cannot choose when a co-owner has sued in court. Then the debtor can only pay him. Read more.
